Public Foundation "Best for Kids"

1.1. This public tender, hereinafter referred to as the "Tender", is a tender from the Public Foundation "Best for Kids", hereinafter referred to as the "Public Foundation", represented by the President of the Foundation K.T. Zharkymbaeva, acting in accordance with the Charter, to conclude with any by the person responding to the Tender, a donation agreement, hereinafter referred to as the "Agreement", on the terms and conditions stipulated by the Tender. This tender is a public tender in accordance with Article 395 of the Civil Code of the Republic of Kazakhstan

1.2. The tender comes into force the day after it is posted on the Public Foundation's website on the Internet at,

1.3. The tender is not limited and is valid until the day following the day of posting notification of the cancellation of the Tender on the website of the Public Foundation. The Public Foundation has the right to cancel the Tender at any time.

1.4. The Public Foundation is ready to conclude donation agreements in a different way and (or) on other conditions other than those specified in the Tender, for which any interested person has the right to apply to the Public Foundation to conclude an appropriate agreement.

2. Subject of the agreement.

2.1. In accordance with this agreement, the donor, as a voluntary donation, transfers his own funds to the current account of the Public Foundation in any way, and the Public Foundation accepts this donation and uses it for statutory purposes. The fact of transferring the donation indicates the full consent of the donor with the terms of this agreement.'

2.2. Performance by the Donor of actions under this agreement is a donation in accordance with Article 516 of the Civil Code of the Republic of Kazakhstan.

2.3. The donor donates funds to the Public Foundation in the amount determined by the donor for the foundation, to provide charitable assistance, in accordance with the foundation's statutory goals and current charitable programs. The donor can obtain information about the nature and amount of assistance needed for specific people, as well as about charitable programs.

3. Activities of the Public Foundation.

3.1. Collection of voluntary donations from individuals and legal entities to provide programs aimed at providing medical equipment to hospitals and provisional centers.

3.2. Promotion of charitable activities.

The Public Foundation is not engaged in commercial activities and is not intended for profit.

3.4. The Public Foundation publishes information about its work and reports on the results of its activities on the websites,

4. Donation

4.1. A donor is an organization or individual that provides donations or other resources on a non-commercial basis for the purposes of the Public Foundation.

4.2. Donor activity, that is, the provision of gratuitous assistance to a charitable foundation.

4.3. The donor independently determines the amount of the voluntary donation and makes it by transferring funds to the bank account of the Public Foundation using any payment method indicated on the website, in accordance with the terms of this Agreement.

4.4. A donor can make a one-time donation through a bank using details, including an electronic payment system, by donating using a credit or debit card or using the bank's mobile application.

4.4.1. The donor may also sign up for a monthly donation subscription through an electronic payment system using a credit or debit card. Subscriptions can be cancelled on the website:

4.4.2. The fact that the donation was transferred to the account of the Public Foundation in any of the possible ways indicates the full consent of the donor with the terms of this agreement.

4.4.3. If the donation transfer method selected by the donor includes the definition "Purpose of payment", the donor, at his choice, indicates one of the following options:

- Donation for statutory activities. Not subject to VAT.

- Donations for current programs. Not subject to VAT.

4.4.4. When transferring a donation, for the correct identification of the payer, the Donor indicates his contacts: e-mail address and phone number.

5. Rights and obligations of the parties

5.1. The Public Foundation is obliged to use the funds received from the Donor under this agreement strictly in accordance with the current legislation of the Republic of Kazakhstan and within the framework of its statutory activities.

5.2. The donor has the right, at its discretion, to choose the object of assistance, indicating the appropriate purpose of payment when transferring a donation. The current list of projects is published on the website, in social networks and the media.

5.3. When receiving an unaddressed donation, the Public Foundation independently determines its use, based on the approved budget items, which are an integral part of the activity.

. After receiving a donation, the Public Foundation directs the donation to help implement the Foundation's projects. The Public Foundation uses the donations received for specific projects and for statutory purposes based on common interests aimed at social support and protection of citizens in accordance with the Law of the Republic of Kazakhstan dated January 16, 2001, No. 142-II "On non-profit organizations").

5.5. Donations received without specifying a specific purpose are used to achieve the statutory goals of the Foundation.

5.6. The Donor agrees that the Public Foundation will process any possible personal data provided by the Donor during the voluntary donation (including, but not limited to: name, address, place of residence, email address, bank details, phone number, IP address), including to third parties (on the basis of possible agreements), in order to fulfill this agreement, including the following actions: collection, registration, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access ), depersonalization, email blocking, deletion, destruction of personal data. In all other cases, the Public Foundation undertakes not to disclose the Donor's personal information to third parties without his written consent.

The exception is the requirements for this information on the part of state bodies authorized to request such information.

Consent to the processing of personal data is valid until the Donor collects them in writing.

5.7. The donor has the right to receive information about the use of the donation. To exercise this right: at the request of the donor, the Public Foundation is ready to: confirm the intended use of the donations received with the relevant accounting documents; provide the donor with information about assistance within the framework of an ongoing project.

5.8. The Foundation has no other obligations to the Donor, except for the obligations specified in this Agreement.

6. Other conditions

6.1. In the case of disputes and disagreements between the Parties under this agreement, they will be resolved, if possible, through negotiations. If it is impossible to resolve the dispute through negotiations, disputes and disagreements may be resolved in accordance with the current legislation of the Republic of Kazakhstan in the courts at the location of the Public Foundation.

7. Information about the Public Foundation

The Public Foundation is a legal entity established and operating in accordance with the legislation of the Republic of Kazakhstan.
